Zoning Permits - Accessory Uses Buildings and Structures

An accessory use or structure is defined as: A use or structure subordinate to the principal use or structure on the lot or tract and serving a purpose customarily incidental to the use of the principal building.   Included in this definition are detached residential garages, strorage sheds and barns, carports and picnic shelters.   All accessory buildings and structures require issuance of a zoning certificate prior to placement, or construction on the property.

Residential Uses

All unattached accessory buildings, structures and uses 200 square feet or less may be located in the side or rear yard provided it is set back at least 5 feet from the lot lines.   They shall be located at least 10 feet from the principal building, with a maximum height of 15 feet.   All unattached accessory buildings, structures, and uses 201 square feet or more may be located in the side or rear yard provided it is set back at least 10 feet from the lot lines.   They shall be located at least 10 feet from the principal building, with a maximum height of 18 feet.

In a Residential District (R-R, R-1, & R-1-A) the total square footage of all unattached accessory buildings and structures shall not exceed 3% of the lot area.   If less than 1 acre, maximum is 1,000 sq. ft.   If 1 acre or more, maximum is 2,500 sq. ft.

In a Multi-family District (R-2, R-3 & R-4), the total of all accessory buildings or structures, whether attached or unattached shall not exceed 500 square feet per dwelling unit, and must meet all setbacks for that district.

Business and Industrial Uses

All accessory buildings, structures and uses shall comply with all yard and height requirements applicable to the principal building.   When unattached, an accessory building or structure shall be located a minimum of 10 feet from any adjacent structure or building on the premises.   Before a township zoning certificate can be issued, written approval from the Stark County Regional Planning Commission must be provided.
